Brand Terms of Service

These terms apply when you use Tan Concierge as a product brand (“Brand”) — listing products in our marketplace, running flash drops, sending updates to stockist artists, and offering discounts to Tan Concierge customers. Tan Concierge is operated by Tan Concierge by The Glo CEO (“Tan Concierge”, “we”, “us”). By signing up as a Brand, you agree to these terms.

1. Who can be a Brand

You must represent an established business that manufactures or distributes spray-tan or related beauty products, and you must have the legal authority to list those products and to commit to the discounts, fulfillment terms, and product information you publish on Tan Concierge.

2. Your product listings

You are responsible for the accuracy of every product listing — name, description, ingredients, claims, photos, pricing, and stockist artist relationships. We may remove a listing that we reasonably believe is inaccurate, misleading, unsafe, or in violation of any law (including FDA, FTC, or cosmetics-regulation requirements where applicable).

You retain ownership of your product photography, branding, and assets. You give us a non-exclusive license to display these assets in the marketplace, on artist dashboards, in client-facing pages, and in promotional contexts for as long as your listing is active.

3. The Tan Concierge discount

When you offer a discount through the marketplace, you promise to honor that discount for any artist or end consumer who redeems it correctly during the stated window. You can change or end a discount any time from your dashboard; previously redeemed codes remain valid through their existing terms.

4. Flash drops and sales

Flash drops are time-bound discounts you can broadcast to your stockist artists. You set the pricing, the inventory, and the duration. You are responsible for fulfillment and for any disputes that arise from a flash-drop order.

5. Messages to artists

You may send in-app messages to artists who carry your products. You agree to use that channel for legitimate brand updates only — new product launches, restocks, training, education. You will not use it to spam, harass, or solicit for unrelated services. We may suspend messaging for any Brand that we reasonably believe is misusing the channel.

6. Subscription and payment

Brand plans (Listed, Featured, Pro) are billed monthly or annually through Stripe. Each tier carries different visibility, analytics, and messaging features as described on the pricing page. Subscription fees are charged in advance; you can cancel any time from Settings. Mid-cycle cancellations keep access through the end of the paid period and are not pro-rated.

Your subscription does NOT include a commission on sales made through Tan Concierge. We do not take a cut of your revenue; pricing tiers reflect the cost of the platform and visibility tools, not transaction fees.

7. Acceptable use

You agree NOT to:

• List products you don't have the right to sell or that violate any law
• Make health, safety, or efficacy claims you can't substantiate
• Use the marketplace to compete with Tan Concierge or to scrape competitor information
• Impersonate another brand, misrepresent your relationships, or use third-party trademarks without permission
• Bypass the platform to settle artist or consumer disputes in a way that violates these terms

8. Intellectual property

We own the Tan Concierge platform — software, design, content, brand. You own your product brand, photography, descriptions, and proprietary information. The licenses each of us grants the other under these terms are non-exclusive and end when your listing ends.

9. Termination

You may close your brand account from Settings at any time. We may suspend or close a brand account that we reasonably believe is violating these terms, making unsupported claims, failing to fulfill orders, or putting artists or end consumers at risk. If we close your account for a reason other than your violation, we will refund any prepaid time not yet used.

10. Warranty and liability

Tan Concierge is provided “as is.” To the maximum extent allowed by law, our total liability for any claim arising out of these terms is limited to what you paid us in the 12 months before the claim.

You agree to defend, indemnify, and hold Tan Concierge harmless from any claim brought by an artist or end consumer that arises from your products, your listings, your discounts, or your messages — including product-liability claims, false-advertising claims, or claims of fulfillment failure.

11. Changes to these terms

We may update these terms over time. When we make a material change, we'll bump the version date at the top of this page and ask you to re-accept inside the app at next sign-in. Continued use after that constitutes acceptance.

12. Governing law

These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. Any dispute that can't be resolved informally will be heard in the state or federal courts located in Denver County, Colorado.
